But marketers are humans too. There is a whole field of psychology dedicated to develop still legal ways to trick humans into buying stuff they actually don't need. It is all about communication - which is absurdly hard to regulate (just see the discussion around "fake news"). -

"We've had thousands of clients!" no they haven't, lie.
"We estimate approximately % of customers..." they don't have enough data to support that, lie.
Since when did marketing become lying?
