    Depending on the client you could end up spending more than you would have earned from the job in court. I'd say wave the contract in their face then sue them.

    @flag0 contract, sure, but the NDA (depending on how the agreement was structured) could be separate and apart from the contract.

    make sure it's in the contact from the start that non payment results in the NDA being terminated and source code being made public

    @hcaz code, data and everything else used in the development. That'd make them think twice before not paying a dev.
